These terms govern your use of TermSmith, a vocabulary learning app published by Pursue Learning Ltd, a New Zealand company. By downloading or using TermSmith, you agree to these terms.
The app
TermSmith is an educational app designed to help students learn and practise subject-specific vocabulary. It is available on the Apple App Store for iOS devices.
Free and Pro tiers
TermSmith is free to download and use. The free tier includes all vocabulary content, all practice modes, and progress tracking. Banner advertisements are displayed on the free tier.
TermSmith Pro is an optional auto-renewable subscription that removes advertisements. The current price is NZ$9.99 per year. The subscription is billed through your Apple ID account and renews automatically unless you cancel at least 24 hours before the end of the current period.
You can manage or cancel your subscription at any time in your device's Settings under Subscriptions, or through the App Store. Refunds are handled by Apple in accordance with their terms of service.
AI-powered features
TermSmith includes AI-powered marking in the "Use in a Sentence" and "Command Words" practice modes. AI feedback is generated automatically and is provided for educational purposes only. It is not a substitute for feedback from a qualified teacher or examiner. AI responses may occasionally contain errors or inaccuracies.
AI marking is subject to daily usage limits. Free users receive a limited number of AI-marked responses per day; TermSmith Pro subscribers receive a higher allowance. When the daily limit is reached, a self-check fallback is available so you can continue practising. These limits may change from time to time.
Your content
When you type sentences for AI marking, those sentences are sent to our marking service for processing and are not stored afterwards. You retain ownership of anything you write. We do not claim any rights over your content.
Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the app
- Use the AI marking features to generate content that is harmful, abusive, or unrelated to vocabulary learning
- Attempt to bypass, manipulate, or circumvent usage limits, rate limits, or subscription entitlements, whether through technical means or by exploiting the app's design
- Interfere with or disrupt the app's services or servers
- Use the app for any unlawful purpose
Intellectual property
TermSmith, its content, design, and code are owned by Pursue Learning Ltd and are protected by copyright and other intellectual property laws. The vocabulary definitions, practice content, and educational materials are original works created for this app.
You may not reproduce, distribute, or create derivative works from the app's content without written permission from Pursue Learning Ltd.
Availability and updates
We aim to keep TermSmith available and up to date, but we do not guarantee uninterrupted access. We may update the app, change features, or modify pricing with reasonable notice. Updates may be required to continue using the app.
Limitation of liability
TermSmith is provided "as is" without warranties of any kind. To the maximum extent permitted by New Zealand law, Pursue Learning Ltd is not liable for any indirect, incidental, or consequential damages arising from your use of the app.
TermSmith is a study tool, not a guarantee of exam results. Your results depend on how you use the app alongside your broader study programme.

Your privacy matters to us. Please read our Privacy Policy for details on what information TermSmith collects and how it is used.
Governing law
These terms are governed by the laws of New Zealand. Any dispute arising from these terms or your use of TermSmith will be subject to the exclusive jurisdiction of the courts of New Zealand.
Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top of this page will change. Continued use of TermSmith after a change means you accept the updated terms.
